GENERAL TERMS OF SALE AND USER TERMS (December 17th 2025)
This online marketplace is owned by Eventim Sweden AB (‘Eventim’), Company reg. no. 556805–2913, Wallingatan 38, 111 24 Stockholm, Sverige, telefon 0771 130 150.
You accept these general terms of sale, see clauses 1-11, by
• purchasing items on the Platforms and or by calling Eventim’s customer service (‘tele purchase’) such as tickets offered by an Event Organizer and associated goods or services offered by an Event Organizer or one or more other Third-Parties (collectively the ‘Products’), see clause 1.1.
In addition, you accept the user terms for Eventim’s Platforms, see clauses 12-17 when
• accessing, browsing, downloading, registering or in other ways using (i) Eventim’s website www.eventim.se, and/or (ii) Eventim’s App (collectively the ‘Platforms’)
The general terms of sale and the user terms are collectively referred to as the ‘Terms’.
Some Products are subject to either additional event or product specific terms. If so, you will be re-quired to actively accept the specific terms during the purchase flow. In case of discrepancies be-tween the Terms and the specific terms, the specific terms will take priority.
The Terms, any applicable specific terms, and the specification of the purchase (the ‘Purchase Re-ceipt’, see clause 2.1) constitute the (i) agreement between Eventim and you, and (ii) the agreement between the Event Organizer, the Third-Party (if any), and you.
IMPORTANT INFORMATION ON PURCHASE ON THE PLATFORMS AND TELE SALES
Eventim is a service provider that facilitates (i) Event Organizers’ sale of tickets, and (ii) Event Organizers’ and Third-Parties’ sale of associated goods or services, on the Platforms and by calling Eventim’s customer service. Eventim is solely responsible for the Platforms, provid-ing tele purchase and its own services, i.e., making Product purchase available on the Plat-forms and by telephone. Consequently, in relation to the event and/or associated goods or services the Event Organizer and Third-Party (if any) are your contracting party and solely responsible for fulfilling their agreement with you and complying with your consumer rights, e.g., the completion of the event, delay, cancellations, changes, and bankruptcy.
The Event Organizer is entitled to alter the event, e.g., changes to the repertoire and/or the performers, the date, partial performance of the event, rescheduling of the event, changes in seating (within the same ticket category as well as to move to a different category against refund of price difference, if relevant), etc. Such changes do not constitute a cancellation (see clauses 7.1 and 7.2) and does not entitle you to refund(s).
If the Event Organizer cancels the event, you are entitled to a refund from the Event Organiz-er of the ticket price itself, but other services will not be refunded, e.g., order fees, ticket fees, delivery costs (for delivered Products), insurance or payments for other associated goods and services. Further, any other costs related to your participation in the event, e.g., transporta-tion, housing, are at your own risk. Accordingly, the Event Organizer is not liable for such costs if the Event Organizer cancels the event (see clause 7.2).
The Terms only applies to consumer purchases (see clauses 1.4-1.6). When completing a Product purchase on the Platforms or by telephone, you confirm that you do not buy Products as a trader, for resale or other commercial purposes. GENERAL TERMS OF SALE
1 Contractual obligations and restrictions on commercial use
1.1 Eventim is an online marketplace and telephone service provider that facilitates (i) Event Or-ganizers’ sale of tickets, and (ii) sale of associated goods or services by Event Organizers and Third-Parties.
‘Event Organizer’ means the third-party event organizer responsible for the specific event and who is your contracting party. ‘Third-Party’ means a third-party (if any) who is your contracting party for an associated good or service. The Event Organizer and Third-Party (if any) are listed in the specific event description, in the purchase flow and your Purchase Receipt (see clause 2.1). The Event Organizer is also listed on the ticket.
1.2 To purchase Products, you must be at least 18 years old and have a valid user account with Eventim (see clause 13). To create a valid user account with Eventim, you must provide your name, postal address, telephone number and email address and have a confidential and per-sonal password for your user account.
1.3 When purchasing Products, the Terms, any applicable specific terms, and the Purchase Re-ceipt, see clause 2.1, constitute (i) the agreement between Eventim and you, and (ii) the agreement between the Event Organizer, the Third-Party (if any), and you. The agreements are legally binding when you have completed the purchase flow. This means that:
1.3.1 When purchasing Products, you agree to pay any charges applicable.
1.3.2 Eventim is your contracting party in relation to the Platforms, tele purchase and its own ser-vices. Accordingly, Eventim is responsible for making Product purchase available on the Plat-forms and by tele purchase.
1.3.3 The Event Organizer is your contracting party in relation to the event and associated goods or services offered by the Event Organizer. Accordingly, the Event Organizer is responsible for fulfilling its agreement with you and complying with your consumer rights in relation to your agreement concerning the event and associated goods or services, e.g., the completion of the event, delay, cancellations, changes, and bankruptcy.
1.3.4 The Third-Party is your contracting party in relation to goods or services offered by the Third-Party. Accordingly, the Third-Party is responsible for fulfilling its agreement with you and com-plying with your consumer rights in relation to your agreement, e.g., providing the goods or services, defects, changes, and bankruptcy.
1.4 Only consumers can buy Products on the Platforms and by tele purchase. When completing a Product purchase, you confirm that you do not purchase Products as a trader, for resale or other commercial purposes, e.g.
• prizes in competitions or similar,
• incentives or bonuses for other services, e.g., travels, restaurants, hotels,
• business sales or transfer of tickets, irrespective of the price.

If your ticket is used or transferred for commercial purposes, your ticket will be canceled. Eventim has the right to invoice you all direct costs related to the cancellation, with a mini-mum of SEK 500 per cancelled ticket.
1.5 A notice from your contracting party, i.e., either Eventim, the Event Organizer or Third-Party (if any), concerning your agreement, including notification of changes and cancellation (see clause 7), is considered to have been received by you if the notice is sent to you via email, text message (SMS) or in-app push notifications. Your contracting party may in connection with such notice direct you to obtain further information elsewhere, e.g., a specified website.
2 Product purchase and payment methods
2.1 To make a purchase on the Platforms, you must:
1. Search and find the Products you wish to purchase.
2. Log in to your user account. If you do not already have a user account, you can easily create one (see clause 13).
3. Enter customer data and select delivery method.
4. Accept the Terms and any applicable specific terms.
5. Choose payment method and confirm that purchase information is correct.
6. The total costs will appear separately before the payment is completed. Approve and complete your purchase.
7. Your order confirmation will now appear, and within a few minutes, you will receive a re-ceipt with a specification of your purchase by email ('Purchase Receipt’). You may access a purchase overview on your user account on the Platforms, but you cannot access your previous purchased agreement.
8. Products are delivered in accordance with your chosen delivery method.
2.2 To make a tele purchase you must:
1. Call customer service and inform them of which Products you wish to purchase.
2. Choose delivery method.
3. Provide customer data. To purchase tickets, you must have a user account. If you do not have a user account, customer service will assist you herewith (see clause 13).
4. Choose payment method.
5. Customer service will summarize the purchase information and the total cost.
6. Confirm the purchase information and accept the Terms and any applicable specific terms.
7. Approve and complete your purchase.
8. Within a few minutes, you will receive a receipt with a specification of your purchase by email ( ‘Purchase Receipt’). You may access a purchase overview on your user account on the Platforms, but you cannot access your previous purchased agreement.
9. Products are delivered in accordance with your chosen delivery method.
2.3 You can pay for the Products by Swish, MasterCard and VISA. All payment communication be-tween you and the provider of the payment solution is encrypted. For some Product purchas-es on the Platforms, you can also pay with Klarna if you are a Swedish resident. Payments are processed by different payment solution providers depending on the chosen payment meth-od.
2.3.1 How to pay with Klarna (third-party credit agreement): Choose Klarna as payment method in the purchase flow. In addition to the Purchase Receipt, you will receive a separate invoice from Klarna with payment information. You have 30 days to pay your Klarna invoice. Please note that when paying with Klarna, Klarna acts as an independent data controller. Read more here.
2.4 Saving your payment card information for future purchases: When purchasing Products on the Platforms, you may choose to save your payment card information for future purchas-es. For security reasons, you will be asked to provide the 3-digit card verification code (CVC) for every purchase. Your payment card information is recorded and stored by a third party ap-proved in accordance with international security standards (PCI DSS - Payment Card Industry Data Security Standard). All card information is encrypted in a secure socket layer (SSL) proto-col. You can revoke your consent to store your payment card details at any time, either in connection with future purchases or by contacting Eventim’s Customer Service at kundservice@eventim.se.
3 Prices, costs, and fees
3.1 All prices are listed in SEK and include applicable VAT.
3.2 When completing a purchase, you may be charged:
• The listed ticket price (payment to the Event Organizer)
• A ticket fee per ticket (payments to Eventim), which is individual for each event. The ticket fee is listed in the purchase flow.
• An order fee per order or ticket (payment to Eventim) which is individual for each event. The order fee is listed in the purchase flow.
• Other applicable fees and costs depending on your specific purchase, e.g., delivery costs, costs for associated goods or services (payment to the Event Organizer or Third-Party), e.g.:
o Delivery costs. The delivery costs depend on the ticket delivery method:
• standard ordinary mail (SE): SEK 59 per order.
• standard ordinary mail (international, incl. Faroe Islands and Greenland): SEK 99 per order.
• mobile delivery: SEK 10 per order.
o Other costs and fees:
• Ticket purchase by phone: SEK 35 per ticket.
• Change of ticket: If the Event Organizer allows it, you may contact Eventim and request to change your ticket within price categories, upgrades, different seats, or date, subject to a handling fee of SEK 125. The change will be made by issuing a new ticket.
• Replacement of lost ticket: SEK 60 administration fee and any applicable deliv-ery costs.
• Name changes to personal named ticket: If the Event Organizer allows it, you may request Eventim to change the name, subject to an administration fee of SEK 60 and any applicable delivery cost
• Transfer/reselling on FanSALE: Generally, the seller must pay a fee of 5% and the buyer a fee of 10% of the resale price. In special cases, the fee is different and this will be stated in the specific event description. You cannot sell your ticket for more than the original ticket price (including ticket fee, but not any other fees or costs), or sell your ticket on fanSALE if the ticket has been partially or ful-ly paid by voucher or gift card. Be aware that some tickets cant be resold on fanSALE. See more at fanSALE.se.
• When paying with Klarna: Credit fee as listed in the purchase flow.
4 Delivery
4.1 The available delivery method(s) will be listed specifically in the purchase flow. Some ticket delivery methods are subject to fees:
4.1.1 Delivery by ordinary mail: Your ticket is sent as soon as possible to the delivery address that you have provided. You will receive an email when your ticket is sent. Expected delivery from time of purchase:
• standard ordinary mail (SE): 7-9 business days
• standard ordinary mail (international, incl. Faroe Islands and Greenland): 14-20 business days
• Delivery of special ticket types, may have longer delivery times, than stated above. In these cases, the expected delivery time will be stated in the event description
Ordinary mail delivery is not insured. If you do not receive your ticket, please contact Even-tim’s Customer Service (see also clause 5.2).
4.1.2 Delivery by Print@Home: Shortly after you have completed the purchase, your ticket is sent to the email address that you have provided. You are responsible for ensuring that the information you enter is correct. Billetlugen is not liable if incorrect information results in tickets not being received. If you do not receive an email within 24 hours of the purchase, please contact Eventim’s Customer Service within opening hours. (see also clause 5.2).
4.1.3 Delivery by Mobile Ticket: Your ticket is delivered directly to your phone by way of link, that you receive in your Purchase Receipt. You can also retrieve your ticket from your user ac-count.
4.1.4 Delivery by Eventim.PASS: You will receive your ticket in the form of a QR code within the App. Your ticket is issued directly to you and is accessible only through your user account in the App. Consequently, if you purchase a ticket for someone else, they must accompany you to the event for admission, unless they forward the ticket via Eventim's app. Additionally, you have the option to resell your ticket through Billetlugen's fanSALE platform. It is important to note that selling your ticket for a price exceeding the original ticket price (including ticket fee, but exclusive of any other fees or costs) is not possible. Typically, the seller is subject to a 5% fee, and the buyer a 10% fee of the resale price. However, in certain instances, this fee may vary and will be detailed in the specific event description. 4.2 Some delivery methods for purchase of goods are subject to fees:
4.2.1 Delivery by ordinary mail: The goods are sent as soon as possible to the delivery address that you have provided. You will receive an email when the goods are sent. Expected delivery from time of purchase:
• standard ordinary mail (SE): 7-9 business days
• standard ordinary mail (international, incl. Faroe Islands and Greenland): 14-20 business days
• Delivery of special ticket types, may have longer delivery times, than stated above. In these cases, the expected delivery time will be stated in the event description.
Ordinary mail delivery is not insured. If you do not receive your goods, please contact Eventim’s Customer Service as soon as possible.
5 Your ticket and access to the event
5.1 Your ticket has an activated barcode/QR code, which is the admission pass to a specific event. If your ticket is cancelled, the barcode/QR code is deactivated. Consequently, a cancelled tick-et does not constitute a valid admission pass.
5.2 Replacement of lost ticket: If you have lost your ticket before the event, Eventim can issue a new ticket to you subject to a fee (see clause 3.2).
If your delivery method is ordinary mail, and you have not received your ticket, you may re-quest Eventim to send you a new ticket cost free. The new ticket will have a new barcode/QR code, and the barcode/QR code on the lost ticket is deactivated. Consequently, the original ticket will no longer constitute a valid admission pass, and this means that once Eventim has issued a new ticket to you, you cannot withdraw your request for replacement.
5.3 Personal named ticket: For some events, your ticket is issued as a personal and named ticket. This means that each ticket is registered to the event with each individual ticket own-er’s first and surname, and that valid photo ID (passport, driver’s license, ID card or similar) must be presented at the event entrance for admission to the event. If a valid photo ID is not presented, admission to the event will be refused.
5.3.1 Transfer of personal named ticket: For some events, transfer of a personal named ticket is not available, or certain requirements may apply. Such requirements and restrictions are clearly listed in the Terms, purchase flow and the Purchase Receipt. If transfer is allowed, your ticket may only be resold via fanSALE, or by requesting a transfer by contacting Eventim’s Customer Service on tel. +46 771 130 150. Transfer through Eventim’s Customer Service (see clause 3.2) and fanSALE (see clause 4.5) is subject to restrictions and fees.
5.3.2 Name changes: For some events name change, i.e., change in spelling or due to a person’s legal name change, is not available, or certain restrictions may apply. Such restrictions are clearly listed in the Platforms’ event description and purchase flow and the Purchase Receipt. Name change to a personal named ticket, if possible, can only be performed by contacting Eventim’s Customer Service on tel. +46 771 130 150, and is subject to a fee (see clause 3.2). Request for name change cannot be made later than 5 PM on the day before the event. A re-quest for a name change to a personal named ticket can only be made by you as the purchaser of the ticket, and not any other person even if the ticket is registered to said person’s name.
5.4 Restrictions concerning safety, health, etc.: Restrictions for access to and running an event may apply to the Event Organizer and/or be introduced by the Event Organizer, e.g., re-strictions concerning safety, health, or other matters. Such restrictions can, e.g., be im-posed by law, authorities or performing artist(s), and may restrict your admission to an event although you present a valid ticket at the event entrance, e.g., requirement of official health pass (Covid-19 pass or similar), and/or affect your event experience, e.g., distance, seating and/or mask requirements.
5.4.1 If the Event Organizer cancels the event or your ticket due to restrictions, you are entitled to a refund of the ticket price from the Event Organizer, but other services will not be refunded, e.g., order fees, ticket fees, delivery costs (for delivered Products), insurance or payments for other associated goods and services (see also clause 7.2). You cannot make any claim(s) against the Event Organizer due to changes or restrictions, e.g., changes to your seating, the running of the event, or if you are denied access due to your noncompliance with the applica-ble restrictions, e.g., not having a valid Covid-19 pass.
5.4.2 Participation in an event is always at your own risk. This means that you cannot make a claim against the Event Organizer if you experience health issues after an event, e.g., infection with coronavirus (Covid-19), other pathogenic organisms, diseases, etc.
6 Right to withdraw
6.1 Tickets, transportation, catering, accommodation, car rental or services related to leisure ac-tivities for a specific date or period are not subject to right to withdraw, cf. 2 kap. 11 § p. 12 i lag (2005:59)
6.2 You cannot withdraw from purchase of Eventim’s services, i.e., making Product purchase available on the Platforms and/or tele purchase. The service has begun with your prior accept and acknowledgement that you will forfeit the right to withdraw once the service has been ful-ly performed, which is at the time that you complete your purchase on the Platforms or by telephone, cf. 2 kap. 11 § p. 11 i lag (2005:59)
6.3 Right to withdraw for goods and other services: If you purchase goods or services (other than specified in clause 6.1 and 6.2) or are otherwise exempt from the right of withdrawal from the Event Organizer or a Third-Party and you are residing in the EU or EEA, you may with-draw from the purchase within 14 days. The period during which the right of withdrawal can be exercised runs (i) for services from the day on which the agreement is entered into, and (ii) for goods from the day on which you obtain the goods in physical possession.
6.3.1 You may email a notice, which states that you, the buyer, are making use of your right to withdrawal, or words of similar meaning. Please also include the email address or telephone number associated with your user account along with your order number. This notice may be sent to Eventim, who will then handle your request on behalf of the Event Organizer or Third-Party. You can also send the notice directly to your contracting party, i.e., the Event Organizer og Third-Party. Contact information for the Event Organizer and/or Third-Party is listed on your Purchase Receipt. If you have sent the notice within 14 days after the delivery, the deadline to withdraw is considered to have been met. You may also use the standard withdrawal form (Annex 1), but this is not a requirement.
6.3.2 In the case of withdrawal from a contract for goods, you must send the goods back to your contracting party (i.e., the Event Organizer or Third-Party) without undue delay and no later than 14 days from the date on which you communicated your decision to withdraw from the purchase. The withdrawal period shall be deemed to have been complied with if you return the goods before this fourteen-day period has expired.You must pay the direct cost of return-ing the goods. You are liable only for any diminished value of the goods resulting from the handling of the goods other than what is necessary to establish the nature, characteristics and functioning of the goods.
6.3.3 In the case of withdrawal from purchase of a service, you are required to pay for the part of the service which has already been delivered.
6.3.4 If you withdraw from a purchase, all payments regarding the purchased goods or services will be refunded without undue delay, including delivery costs (but not additional costs due to your own choice of a form of delivery other than the cheapest standard of delivery we offer, and in any case when (1) for goods: the applicable seller, i.e. the Event Organizer or Third-Party, has received the goods back, or you have supplied evidence of having sent back the goods, whichever is earlier; when (2) for services: within 14 days of the date Eventim re-ceived notice of your decision to withdraw. Refunds will be made by using the same means of payment as used by you in the initial purchase. In any case, no fees will be charged to you because of the refund.
7 Event changes, cancellations, and refunds
7.1 Changes: The Event Organizer is entitled to alter the event, e.g., changes to the reper-toire and/or the performers, the date, partial performance of the event, rescheduling of the event, changes in seating (within the same ticket category as well as to move to a different category against refund of price difference, if relevant), etc. Such changes do not constitute a cancellation (see clause 7.2).
7.2 Cancellations: An event is only considered cancelled if the event is not performed at all. If the Event Organizer cancels the event, you are entitled to a refund from the Event Organizer of the ticket price itself, but other services will not be refunded, e.g., order fees, ticket fees, delivery costs (for delivered Products), insurance or payments for other associated goods and services. Further, any other costs related to your participa-tion in the event, e.g., transportation, housing, are at your own risk. Accordingly, the Event Organizer is not liable for such costs if the Event Organizer cancels the event.
7.2.1 If you are entitled to a refund, you must contact Eventim (who acts on behalf of the Event Organizer) with your claim. Only if agreed with the Event Organizer, and if Eventim have sufficient funds from the event organizer, Eventim may process your refund on behalf of the Event Organizer. In such case, the refund will be made using the same means of payment as used by you in the initial purchase.
7.2.2 In the event of suspicion of fraudulent behavior, the Event Organizer is entitled to cancel your ticket and deactivate the barcode/QR code (see also clause 5.1). If the Event Organizer cancels your ticket, you are entitled to a refund from the Event Organizer of the ticket price itself, but other services will not be refunded, e.g., order fees, ticket fees, delivery costs (for delivered Products), insurance or payments for other associated goods and ser-vices. Further, any other costs related to your participation in the event, e.g., transportation, housing, are at your own risk. Accordingly, the Event Organizer is not liable for such costs if the Event Organizer cancels your ticket.
If your ticket is used or transferred for commercial purposes, your ticket will be canceled, and you must bear all direct costs related to the cancellation, with a minimum of SEK 500 per can-celled ticket, see clause 1.4.
8 Force majeure
8.1 Your contracting party, i.e. Eventim, the Event Organizer or Third-Party, respectively, will not be considered to have failed to perform its contractual obligations (see clause 1.3) in the event and to the extent that non-performance is due to an event or condi-tion that is outside your contracting party’s control and not reasonably foreseeable, and which effects cannot reasonably be avoided or overcome.
8.1.1 This includes, e.g., war, armed conflicts, emergency situations, lockdown, riot or other crises, provision of emergency information during crises or in disturbances of normal situations, sabotage or threat of sabotage, dangerous epidemic, pandemic, storm, flood, or other inclement weather or other natural event (disaster), fire, explosion or other similar accidents, strike, lockout, boycott and other industrial actions (including inter-nal strikes), legislative changes, action or failure to act on the part of authorities, ex-change restrictions, restriction of export and import, interruption of general supply of energy, general unavailability of transport, interference of communications networks, defects or delays in transfer connections or other connections, equipment acquired from third-parties or in control of third-party or other similar reason beyond the con-trol of the parties, or failure to perform by third parties, including suppliers and sub-contractors.
9 Liability and disclaimer
9.1 You agree, to the extent permitted under applicable law, to indemnify, defend and hold Eventim, the Event Organizer and Third-Parties harmless against all complaints, de-mands, claims, damages, losses, costs, liabilities, and expenses, including attorney’s fees, due to, arising out of, or relating in any way to your access to or use of the pur-chased Products.
9.2 Limited by the applicable mandatory regulation: Your contracting party, i.e., Eventim, the Event Organizer and/or Third-Party, is not liable for any damages or costs that oc-cur in relation to your agreement, including but not limited to transportation, housing, baggage, loss or damage of personal possessions or valuables, medical emergencies, in-juries, illness, emotional trauma, etc. Further, your contracting party will under no cir-cumstances be liable for consequential losses, e.g., cost related to housing, transporta-tion, etc., except as required by mandatory regulation.
If your contracting party, in spite of this clause 9.2, is considered liable for any damag-es or costs, such liability is, limited by the applicable mandatory regulation, reduced or lapsed in the event of any negligence on your behalf that caused or contributed to the damage. Furthermore, such liability is limited to the amounts that you have paid to your contracting party.
10 Personal data and cookies
10.1 When you purchase Products, Eventim, and in some instances the Event Organizer and/or Third-Party, processes your personal data. For further information, please see Eventim’s Data Policy.
11 Complaints, disputes and choice of law and venue
11.1 Complaints regarding the Platforms, tele purchase and Eventim’s services: Any ques-tions or complaints must be directed to Eventim Sweden AB, Company reg. no. 556805 Wallingatan 38, 111 24 Stockholm, Sweden, email: kundservice@Eventim.se, telephone: 0771 130 150.
11.2 Complaints regarding the event: Any questions or complaints must be directed to the Event Organizer, who is your contracting party (see clause 1.3.3). Contact information for the Event Organizer is listed on your Purchase Receipt. If there is a problem with the physical conditions during the event, e.g., restricted access or view, you must immediately contact a representative of the Event Organizer. If you do not contact a representative, you may lose your right to complain.
11.3 Complaints regarding goods: The rules of the Swedish Sale of Goods Act apply. Any ques-tions or complaints must be directed to your contracting party, i.e., the Event Organizer or Third-Party (see clauses 1.3.3 and 1.3.4). Contact information for the Event Organizer and Third-Party, if any, is listed in your Purchase Receipt.
11.4 Complaints regarding services (other than the event): Any questions or complaints must be directed to your contracting party, i.e. the Event Organizer or Third-Party (see clauses 1.3.3 and 1.3.4). Contact information for the Event Organizer and Third-Party, if any, is listed in your Purchase Receipt.
11.5 Allmänna reklamantionsnämnden (ARN) and ODR. Should you not find a solution, you can make a complaint ARN via www.arn.se eller per post till Box 174, 101 23 Stockholm. When submitting the complaint, you must provide an email address for your contracting party sub-ject to the complaint. The email address for Eventim, the Event Organizer and/or Third-Party, if any, is listed in your Purchase Receipt.
11.5.1 The European Commission's online complaint portal may also be used for a complaint. This is particularly relevant if you are a consumer domiciled in another EU country. You can file the complaint through the following link: http://ec.europa.eu/odr.
11.6 Except when prohibited by mandatory regulation on choice-of-law or venue, the agreement between Eventim and you, and the agreement between the Event Organizer, the Third-Party (if any), and you is governed by and construed in accordance with Swedish law.
11.7 If any provision of these Terms is or becomes invalid, unenforceable, or non-binding, you con-tinue to be bound the remaining provisions. In such event, such invalid provision shall none-theless be enforced to the fullest extent permitted by applicable law.
TERMS FOR USE OF EVENTIM’S PLATFORMS
12 The Platforms and compatibility
12.1 To use the Platforms, you will need a compatible browser and/or device. Eventim cannot guarantee that the App is compatible with or available on your device. Any costs related to your mobile or data provider, e.g., for messaging, data, and other charges, will apply regard-less.
13 Creation and management of your user account
13.1 To create a valid user account with Eventim, you must provide your name, postal address, telephone number and email address and apply a confidential and personal password for your user account. You are responsible for ensuring that the information you enter is correct. Billetlugen is not liable if incorrect information results in tickets not being received
13.2 You may not impersonate someone else, create, claim, or use a user account for any-one but yourself, provide an email address other than your own, or create fake or mul-tiple user accounts.
13.3 To the widest extent possible pursuant to applicable law:
• You are responsible for ensuring the confidentiality of the data for your user account, and fully responsible for all activities under your user account.
• Eventim is not liable for any loss or damage arising from your failure to comply.
13.4 You agree to:
• immediately notify Eventim of any unauthorized use of your user account or any other breach of security.
• provide true, accurate, current, and complete information about yourself and maintain and promptly update the data to keep it true, accurate, current, and complete.
13.5 Eventim will not verify the information you register on your user account. If you provide any information that is untrue, inaccurate, not current, or incomplete, or Eventim has reasonable grounds to suspect that such information is untrue, inaccurate, not current, or incomplete, Eventim has the right to suspend or terminate your user account and to refuse you all current or future use of the Platforms or purchase of Products.
13.6 You may stop using the Platforms at any time and close your user account by contacting kundservice@Eventim.se. After your user account is terminated, the Terms will terminate ex-cept the following provisions that will still apply: Clauses 8, 9, 15, 16.
13.7 If Eventim suspects that you do not comply with clauses 13.1-13.5, Eventim may ter-minate your user account without prior notice. You cannot make a claim against Even-tim due to such termination, e.g., concerning loss of tickets.
14 Amendments and software updates
14.1 To ensure the continuous functionality of the Platforms and bring you additional functionalities, Eventim may from time to time add new features or enhancements as well as remove fea-tures in the Platforms. Further, Eventim constantly updates its Platforms, including its soft-ware, this being the only way to make improvements to it, offer new services and fix potential bugs. Each software update from Eventim may result in the deletion of previously available features or in the addition of new ones.
Provided that these changes do not materially affect your rights or obligations, Eventim will not provide you with notice beforehand. If the changes are material, Eventim will notify you in accordance with current legislative requirements.
14.2 Whenever a new update is published, Eventim will no longer offer technical support for the previous versions.
14.3 An update may require that the device on which it is to be installed meets certain technical requirements to work properly. You must carefully read said requirements before installing a new update.
14.4 Your use of the Platforms following the posting of a modified version of the Terms will mean you accept that modified version. If the modified terms are not acceptable to you, your only option is to stop using the Platforms.
15 Intellectual property rights and restrictions of use
15.1 Eventim, the Event Organizer and Third-Parties retain ownership of all proprietary rights to the Platforms and the Products, and in all trade names, trademarks and service marks associated or displayed herewith. When you download any software from the Platforms or any App Provider, in relation to the Platforms, Eventim only grants you a limited, personal, non-transferable, and non-exclusive license to use such software. With respect to any open source or third-party code that may be incorporated in the Platforms, such open-source or third-party code is covered by the applicable open source or third-party license (EULA), if any, authorizing use of such code.
15.2 Eventim exclusively retains ownership of all rights, titles, and interests in and to all intellectual property rights as well as the rights to the look and feel including infrastructure of the Plat-forms, etc.
15.3 The Platforms is made available for personal and non-commercial use only. You are not al-lowed to:
• re-sell, hyper/deep-link, use, copy, publish, modify, translate, decompile, reverse engi-neer, decipher, transmit, create any derivative works from, make use of, use as meta tags, reproduce in any way, promote, market, integrate, utilize, combine, monitor (e.g., spider, scrape), use datamining, frame, mirror, display, download, reproduce, or otherwise use any content on the Platforms, including but not limited to any pictures, images, copy-righted material, trademarks and names, service marks, or other intellectual property, proprietary information or any other content or information, software, without Eventim’s prior written consent;
• use or develop applications that interact with the Platforms, without Eventim’s prior writ-ten consent; or
• use, store, upload viruses or other malicious ware or compromise the security of the Plat-forms or promote behavior in violation of the Terms.
16 Personal data and cookies
16.1 When you use the Platforms, Eventim processes your personal data. For further information, please see Eventim’s Data Policy.
17 Liability and disclaimer
17.1 You agree, to the extent permitted under applicable law, to indemnify, defend and hold Even-tim, the Event Organizer and Third-Parties harmless against all complaints, demands, claims, damages, losses, costs, liabilities, and expenses, including attorney’s fees, due to, arising out of, or relating in any way to your access to or use of the Platform and/or the purchased Prod-ucts.
17.2 The Platforms are provided by Eventim on an 'as is' and 'as available' basis. To the extent permitted by applicable law, Eventim does not guarantee that the Platforms will be uninter-rupted, error- or virus-free. Eventim reserves the right to revise the Platforms or deny access to them at any time. Eventim expressly disclaims any express or implied warranties, includ-ing, without limitation, warranties of title, non-infringement, fitness for a particular purpose, availability, accuracy, reliability, or content of the Platforms. You agree and acknowledge that use of the platforms is at your sole risk. Eventim shall not be liable for any direct, indirect, in-cidental, special or consequential or other damages, lost profits, business revenue, goodwill, anticipated savings, or data, caused using or inability to use the Platforms even if the possibil-ity of such damages has been advised.
